Defective Product Claims Against Essure
Essure is a permanent birth control device manufactured by Bayer HealthCare. It consists of 2 coils and is placed directly in the urethra via a simple surgical procedure. The device provides contraception by blocking eggs from moving through the fallopian tubes so that fertilization cannot take place. The U.S. Food and Drug Administration (FDA) approved the device for use and sale in 2002. However, the device’s manufacturer was later cited by the FDA for violations of postmarket regulations. For example, in 2011, the FDA found Bayer in violation of premarket approval due to the use of unapproved materials in the production of Essure devices. In November 2016, the FDA ordered that a warning be placed on the device’s label, warning of the risk of organ perforation, abdominal pain, and other side effects.
As of October 2016, there were about 10,600 individual lawsuits against Bayer in the U.S. alone. In these lawsuits, women who used Essure allege that the device caused a number of injuries and serious complications, including organ perforation, device migration, internal bleeding, unplanned pregnancies and children born with birth defects. Despite the large number, the lawsuits haven’t yet been consolidated into a multidistrict litigation. In addition, no settlements or trials have been reported as of yet.
