IVC Filter Complications
An IVC filter is a medical device designed to prevent blood clots from reaching the lungs. It is placed directly in the large vein in the abdomen that returns the blood from the lower part of the body to the heart. If a blood clot travels to the lungs, it can cause pulmonary embolism, that is, a blockage of the artery in the lungs. This condition is often fatal.
However, as reported by the Food and Drug Administration (FDA), the filter itself may cause a number of serious health issues. IVC filters have been shown to cause injuries due to filter migration or fracture, perforations, or even embolization – that is the movement of the filter or its fragments to heart or lungs. Thus IVC filters may cause a condition similar to the one they were designed to prevent.
Patients who have suffered such injuries have filed more than 7,000 lawsuits against the main manufacturers of IVC filters – Cook Medical and Bard. The lawsuits have been combined into two multidistrict litigations (MDLs) and moved to courts in Arizona and Indiana. The first round of bellwether trials in these MDLs have recently started and some plaintiffs in these trials have already been awarded money as compensation for their injuries.
Lawsuits filed against Cook Medical and Bard accuse the manufacturers of producing a product that is unnecessarily dangerous, claiming various counts of misconduct under product liability law such as negligence, failure to warn, design defects, manufacturing defects, breach of implied warranty and negligent misrepresentation. Plaintiffs in the lawsuits seek compensation for claims related to wrongful death, pain and suffering, medical expenses, lost wages, physical and emotional trauma, and more.
